These Terms of Service (“Terms”) govern the use of services provided by Retain With Emails, operated by F-LINK CONSULTING (“Company,” “we,” “us,” or “our”). By accessing our website or purchasing our services, you agree to be bound by these Terms.

Our services are offered strictly on a business-to-business (B2B) basis.

2. Services Provided

We provide email marketing services for e-commerce businesses, which may include, but are not limited to:

  • Email flow setup and automation

  • Ongoing email campaign management

  • Strategic planning and optimization

  • Performance tracking and reporting

All services are digital and service-based only.
We do not sell physical products or downloadable digital goods.


3. Service Delivery

3.1 Delivery Method

Services are delivered digitally via platforms such as:

  • Email service providers (e.g. Klaviyo or similar tools)

  • Shared documents

  • Project management tools

  • Email or other agreed communication channels

No physical goods are shipped.

3.2 Onboarding & Start Date

Service delivery typically begins when payment has been received

Start timelines may vary depending on service scope and client responsiveness (typically 1-3 days).


3.3 Delivery Timelines

Delivery timelines depend on the service purchased. Typical ranges may include:

  • Email flow setup: approximately 7–21 business days

  • Ongoing campaign management: recurring delivery during the active service period

Timelines are estimates and may vary based on project complexity, revisions, or delays in client input.


4. Client Responsibilities

Clients agree to:

  • Provide accurate and complete business information

  • Grant necessary access to required platforms and tools

  • Ensure their business complies with all applicable laws and regulations

  • Review deliverables in a timely manner

Delays caused by missing access or incomplete information may impact delivery timelines.


5. Pricing, Payment & Invoicing

  • Services are invoiced in advance, unless otherwise agreed in writing

  • Payments must be made by the invoice due date

  • Failure to pay may result in service suspension or termination

All prices are exclusive of applicable taxes unless stated otherwise.


6. Cancellation & Termination


6.1 Client Cancellation

Clients may cancel services by providing written notice via email.

  • For recurring services, cancellation applies to future billing periods only

  • Notice must be given before the next billing cycle to avoid additional charges

6.2 Company Termination

We reserve the right to terminate services if:

  • Payments are overdue

  • The client breaches these Terms

  • Continued service would expose us to legal or compliance risk

Outstanding balances remain payable upon termination.

7. Refund Policy

Because our services involve time, labor, and digital work already performed:

  • Services already delivered are non-refundable

  • Setup fees, strategy work, and completed deliverables are non-refundable

  • No refunds are issued for partial service periods once work has begun

If a refund is approved at our sole discretion, it will be processed to the original payment method within a reasonable timeframe.


8. Confidentiality

Both parties agree to keep confidential any non-public business, technical, or financial information shared during the engagement, unless disclosure is required by law.


9. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability is limited to the amount paid for the specific services giving rise to the claim

  • We do not provide guarantees regarding results, revenue, or performance outcomes

10. Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles.

11. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms or our services shall be resolved by binding arbitration administered by JAMS under its Commercial Arbitration Rules.

  • Arbitration will be conducted in English

  • Location will be mutually agreed

Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions or class arbitration.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect upon posting on our website.
